Article 312 of the Women’s Charter provides that a woman is entitled to have an abortion upon request by her at any place approved for such procedure in writing by the Minister of Health and during the first 24 weeks of pregnancy. An abortion involves a procedure to terminate pregnancy in the womb. Article 313 of the Women’s Charter provides that where a woman suffers from any of the conditions set out in 1(a)-(c) of the Second Schedule to the Medical Termination of Pregnancy Act, an abortion can be had at any time during her term of pregnancy if the medical practitioner appointed to carry out the abortion is of the opinion, formed in good faith, that the continuance of the pregnancy would involve risk to the life of the pregnant woman, or injury to the physical or mental health of the pregnant woman greater than if the pregnancy were terminated. Article 314 of the Women’s Charter provides that a woman who performs an abortion after 24 weeks of pregnancy is subject to punishment and a term of imprisonment of up to three years and/or a fine of up to $10,000.
